Terms of service

Terms and conditions of use

These General Terms and Conditions of Sale and the contractual relationship between warew and the purchaser are governed by Italian law. In the event of a dispute, before bringing any legal action, the parties undertake to seek an out‑of‑court resolution.

Welcome to www.warew.it (the “Site”).

Please read these General Terms and Conditions of Sale (the “GTCs”) carefully, as well as the Privacy Policy and Cookie Policy, which govern your browsing of this Site and our relationship in the event you order Products and Services on this Site.

Any purchase of a product offered on the Site implies that you have read and expressly accepted the GTCs. Your acceptance does not require a handwritten signature.

Pursuant to applicable laws and regulations on electronic signatures, validating the purchase order as specified in these GTCs constitutes an electronic signature which, between the parties, has the same legal effect as a handwritten signature and serves as proof of the purchase order and of the sums due under that order.

For the purposes of these GTCs: “You” or the “Buyer” means the person browsing the Site and/or purchasing products on the Site; “We” or the “Seller” means the company identified in the legal notices referred to above; the Buyer and the Seller are jointly the “Parties” and individually a “Party”.

Conditions of Purchase

The Products and services offered on the Site are reserved for persons who:

(i) are of legal age (or minors who hold authorization from the person exercising parental responsibility allowing them to place an order on the Site); and

(ii) have full legal capacity to place orders on the Site.

We reserve the right at any time to request identification proving your age and/or the above authorization.

We reserve the right not to process a purchase order and/or to remove from our customer/prospect database any Buyer who does not respond to such a request or who fails to comply with the principles set out in this clause.

Products are intended for the Buyer’s personal use; their purchase must not be connected to the Buyer’s professional activity, including any resale of the Products.

Products and Prices

Products

The cosmetic products offered for sale on the Site, as well as any related services and/or complementary products (the “Products”), are those available on the Site on the date the Buyer views and/or browses it.

If a Product is unavailable, the Buyer will be informed:

  • when placing the order (a message will indicate the product is temporarily unavailable); or

  • after the order has been validated and before delivery, by email.

If the Buyer requests cancellation of the entire order, the Seller undertakes to refund the sums paid by the Buyer within a maximum of fourteen (14) days from the date of receipt of the request, using the payment method used by the Buyer.

The Buyer is informed that the photographs and texts illustrating the Products are subject to change.

Prices

Prices are indicated in Euro (€) and are valid throughout Italy.

Prices reflect any applicable discounts and VAT on the date the order is placed.

Any promotions granted in the form of discount vouchers are valid for a single order per user within a specified validity period and cannot be combined with other discounts.

The Seller reserves the right to modify prices at any time; however, Products will be invoiced at the rates in effect at the time the order is registered, subject to availability.

Order Placement and Validation

Placing an Order

To place an order, the Buyer must first connect to the Site.

The Buyer may then learn more about the various Products offered for sale on the date of the Site visit and select Products by:

(i) browsing the various Product categories;
(ii) typing the Product name directly into the search bar; or
(iii) clicking on one of the pages in the site map at the bottom of each page to access the full Product range.

While browsing the Site, a Buyer who wishes to place an order can do so by clicking the button to add the Product to the cart. After doing so, the Buyer will see the number of Products in their cart.

The Buyer is informed that cart contents may be subject to expiration.

The Buyer may continue browsing or click the cart to view its contents, including all order items, the essential characteristics of the Products, the total order amount, billing and delivery details, delivery times, costs and any delivery limitations, as well as the Buyer’s rights and statutory guarantees.

At any time during order processing—i.e., until payment is actually made under these GTCs—the Buyer may return to the order, complete it, modify it, or cancel it until it is validated.

Once Product selection is complete, the Buyer can validate the order using the appropriate button. A new page then opens inviting the Buyer to:

  • provide a username (email address) and password if already registered on the Site; or

  • click the button to amend the cart and/or personal details.

The Buyer undertakes to complete the form in good faith.

The Buyer acknowledges that the data communicated to the Seller and stored in the Seller’s and/or subcontractors’ information systems are accurate and constitute proof of identity.

Such personal data will be processed in accordance with the Privacy Policy.

After reviewing the order, the Buyer is invited to:

  • click the button to proceed to payment under these GTCs; or

  • click the button to amend the cart and/or personal details.

By clicking the button to proceed to payment, the Buyer must first read these GTCs and then confirm consent to all of them by performing the confirmation action requested by the Site (e.g., ticking a box).

Once the Buyer confirms acceptance of the GTCs, a page dedicated to payment opens. The Buyer must then proceed to payment under these GTCs.

The data recorded by the Seller constitute proof of all transactions between the Seller and the Buyer.

Order Confirmation

Once the order has been confirmed and payment validated as described above, a printable and savable summary of the Buyer’s order is displayed, showing the order reference.

The Seller will send, as soon as possible, an order confirmation email to the address provided by the Buyer, including:

– the Seller’s identity and contact details;
– the order reference registered upon placement;
– the order summary and the essential characteristics of the products;
– delivery times, costs, and any delivery limitations;
– the total order amount, including taxes;
– the Buyer’s rights and statutory guarantees;
– payment confirmation.

Title to the Product(s) remains with the Seller until the Seller has received full payment of the price and ancillary costs, including shipping costs.

In the event of payment issues, the Buyer undertakes to return the products received to the Seller upon first request.

To protect against fraud, if the Seller or the online payment service provider suspects an order may be fraudulent, the Seller or the payment provider reserves the right to request (before processing the order) additional documents (in particular proof of address and of the debit in the Buyer’s name, a copy of the Buyer’s ID, a copy of the Buyer’s credit card) to verify the order is not fraudulent.

If the Buyer fails to respond within fifteen (15) days from the Seller’s or payment provider’s request, the order will be cancelled and the Seller will refund the order within fourteen (14) days following expiry of that period, via the Buyer’s payment method.

Proof of Order

By express agreement between the Seller and the Buyer, emails are binding between the Parties, as are the automatic recording systems used on the Site, particularly regarding the type and date of the order.

The Buyer may, if necessary and in accordance with applicable law, access the electronic contract concluded between the Buyer and the Seller.

To do so, the Buyer must contact Customer Service and provide all necessary information, particularly the order number and details.

Payment

The amount due by the Buyer is that indicated in the order confirmation and shown on the payment page, and then sent by email from the Seller to the Buyer.

At order validation, the Buyer may choose among several payment methods.

Payment may be made:

  • immediately online by credit card (Visa, Amex, Mastercard); or

  • via PayPal.

The order is validated by the Seller only after acceptance of the GTCs and verification and confirmation of payment validity.

In any case, the Seller reserves the right to refuse any order or delivery in the event of:

(i) exceeding the maximum thresholds indicated in Article 1 – “Conditions of Purchase” of these GTCs;
(ii) an ongoing dispute with the Buyer;
(iii) total or partial non‑payment of a previous order by the Buyer;
(iv) refusal by banking institutions to authorize payment by credit card;
(v) non‑payment or partial payment.

Delivery and Receipt

Delivery Methods

Once prepared, the order is shipped to the postal address provided by the Buyer when placing the order.

Products are delivered by postal services or by a specialized provider (the “Carrier”).

If the Buyer is absent, the Carrier will leave a delivery notice in the Buyer’s mailbox. The product will be available for pickup at the nearest post office.

Timeframes

Orders are prepared by warew’s logistics center in Italy and delivered by the courier chosen by warew (DHL Express).

The Buyer can track the order via the link sent with the shipping confirmation email.

Estimated delivery time: 5–7 business days from the order date. The timeframe is indicative and may change.

* valid where an order is placed before 12:00 (noon) on a business day. If the order is placed after 12:00 or on a non‑business day, add one additional business day.
** for destinations such as the islands, delivery may require one additional business day.

Delivery Delay

warew is not responsible for delivery issues due to events or circumstances beyond its control, including delays attributable to the transport service or loss of products.

In case of delay, please inform Customer Service as soon as possible at: customercare@warew.jp.

The carrier will then be contacted to carry out the relevant checks. The Buyer is informed that such investigations are uncertain and relatively lengthy and beyond the Seller’s control.

If the maximum delivery period of thirty (30) days is exceeded, the Buyer may exercise the right of withdrawal by contacting Customer Service.

From the exercise of the right of withdrawal, the Seller will refund all sums paid by the Buyer (including delivery costs), using the Buyer’s payment method, within a maximum of fourteen (14) days from receipt of the notice, without any further compensation.

Delivery may be made in several shipments. Therefore, in the event of partial delivery, the right of withdrawal may be exercised only for the portion of the order not yet delivered.

If the order is found during the investigation, it will be immediately redirected to the delivery address indicated in the order.

If the investigation confirms the order has been lost, the Seller will, at its expense, reship the Product(s) to the Buyer or, if definitively unavailable, refund the sums collected to the account charged when the order was placed.

Receipt

Each delivery is deemed completed once the Product(s) are made available to the Buyer by the Carrier.

It is the Buyer’s responsibility to check immediately, upon receipt, the conformity and integrity of the Product(s), noting any anomalies or defects on the Carrier’s delivery slip.

Any defect must be notified to the Seller’s Customer Service as soon as possible. A copy of the complaint submitted to the Carrier must be attached.

Statutory Warranties

Pursuant to Articles 129 et seq. of Legislative Decree No. 21/2014 (Italian Consumer Code), the Seller must deliver Products to the Buyer that conform to the Buyer’s order.

Products are presumed to conform if they:

  • are suitable for the use for which goods of the same type are ordinarily used;

  • conform to the description given by the Seller and possess the qualities of the sample or model presented to the Buyer;

  • present the qualities that a Buyer can reasonably expect given the nature of the goods and the public statements made by the Seller on their specific characteristics;

  • are suitable for any particular use intended by the Buyer that was made known to and accepted by the Seller.

Likewise, pursuant to Article 1490 of the Italian Civil Code, the Seller guarantees that the Products sold are free from hidden defects that render them unsuitable for their intended use or significantly diminish their value.

If the Products delivered are not in conformity with the Products ordered by the Buyer or have hidden defects, the Buyer must email the Seller’s Customer Service to report the non‑conformity or hidden defects.

The Buyer has two (2) years from delivery of the purchased Products to exercise the warranty against hidden defects, and it must be asserted by the Buyer within two months from discovery of the defect.

Any claim made after the said two‑year period will be rejected and warew will be released from any liability.

Following notification of non‑conformity or defects, the Seller’s Customer Service will confirm receipt of the Buyer’s request and provide instructions on the procedure to follow.

The Product(s) must be:

(i) returned complete, unused, in their intact original packaging; and
(ii) accompanied by the original packing materials, the return slip provided by the Seller’s Customer Service, and the invoice.

The Seller will not accept parcels sent postage due. Any risk associated with returning the Product(s) is borne by the Buyer.

Upon receipt of the allegedly non‑conforming or defective Product(s), the Seller will inspect them to verify conformity.

The Seller may also perform a quality test on the returned Product(s) to verify they are the original Product(s).

Such inspections will be carried out as soon as possible and within a maximum of one (1) month.

If non‑conformity or hidden defects are confirmed, the Seller will, at the Buyer’s choice:

  • refund the non‑conforming or defective Product(s), together with shipping costs, using the Buyer’s payment method, within fourteen (14) days from receipt of the returned Product(s); or

  • upon the Buyer’s request, replace the non‑conforming or defective Product(s).

Shipment of the Product(s) to the Buyer will be at the Seller’s expense and under these GTCs.

Right of Withdrawal

In full compliance with Article 52 of Legislative Decree No. 21/2014 (Italian Consumer Code), the Buyer has a period of fourteen (14) days from the day of effective delivery of the order to withdraw from the purchase contract for the Products, without giving reasons and without penalties, except for the return shipping costs, which are borne by the Buyer.

In the case of the purchase of multiple Products delivered at different times, the above period runs from receipt of the last item in the purchase order.

If the right of withdrawal is not exercised within the fourteen (14)‑day period above, the order is deemed final and no refund will be made.

The right of withdrawal may be exercised only by the Buyer and not by third parties.

The Buyer may exercise the right of withdrawal within the prescribed time by completing the model withdrawal form delivered with the order, as per Annex 1 to Legislative Decree No. 21/2014, or by sending a free‑form statement expressly declaring the decision to withdraw, to: Chimar s.r.l., Via Pesadori 5, 26013 Crema (CR), Italy.

The Seller will confirm receipt of the Buyer’s withdrawal request.

The Buyer has fourteen (14) days from the date the Buyer informed the Seller of the decision to withdraw to return to Chimar s.r.l., Via Pesadori 5, 26013 Crema (CR), Italy the complete, unused Product(s) in their intact original packaging and, if possible, together with the original packing materials, the return slip, and the invoice.

The direct cost of returning the Products is borne by the Buyer.

If the Products are not returned within the above fourteen (14)‑day period, the order is deemed final and no refund will be made.

The Seller undertakes to refund the Buyer all sums paid. The refund will be made using the payment method used by the Buyer for the initial transaction, within a maximum of fourteen (14) days from the Buyer’s exercise of the right of withdrawal.

Refunds may be withheld until the Products have been returned by the Buyer or until the Buyer has provided evidence of having shipped the goods, whichever occurs first.

Pursuant to Article 59 of Legislative Decree No. 21/2014 (Italian Consumer Code), the right of withdrawal under this article is excluded in the following cases:

  • express waiver by the Buyer;

  • supply of Products made to measure or clearly personalized;

  • supply of sealed Products not suitable to be returned for health protection or hygiene reasons and that have been unsealed after delivery;

  • supply of Products combined with other Products (for example: individual Products within a box set composed of several Products).

For any additional information on the scope, content, and instructions regarding the exercise of the right of withdrawal, the Buyer may contact after‑sales service at: customercare@warew.jp.

The Buyer may save or print these GTCs, provided they are not modified.

The current GTCs can be consulted at any time under “Terms and Conditions,” accessible from all pages of the Site via the footer.

The Seller may update these GTCs at any time.

Each updated version of the GTCs will be made available on the Site in the dedicated section; warew therefore invites all users to consult the Site periodically to remain informed of the latest version.
